Telecommunications Act, 2001 (Act 2001-36)
TELECOMMUNICATIONS (VIDEO TAPE RENTAL SERVICE) REGULATIONS, 2004
The Minister in exercise of the powers conferred on him by section 110(1) of the Telecommunications Act, makes the following Regulations.
1. These Regulations may be cited as the Telecommunications (Video Tape Rental Service) Regulations, 2004.
2. In these Regulations,
"video tape rental service" or "video service" means a service that provides for the rental and display of magnetic tapes consisting of recorded images and sound;
"video tapes" includes both analogue and digital tapes.
3. A person who is desirous of providing a video tape rental service may
(a) on application to the Minister in the form set out in Part I of the Schedule; and
(b) on payment of the relevant fee as specified in the Telecommunications (Licence Fees) Regulations, 2003
obtain a licence for the purpose.
4. A licence under regulation 3
(a) shall be in the form set out in Part II of the Schedule; and
(b) is not transferable. | ||||||||

5. A person who has been granted a licence under regulation 4 shall
(a) keep on the premises on which the video service is operated, a register to be known as the "Video Tape Register," in which shall be entered the names and addresses of every person to whom he has provided the video service;
(b) make the "Video Tape Register" referred to under sub-paragraph (a) available for inspection by the Minister or a person designated by the Minister; and
(c) keep a record book known as the "Video Tape Record Book" in which shall be entered the transactions made by that person in respect of the service.
6. A licence that has been issued under regulation 4 expires one year from the date of the grant of the licence and is renewable on payment of the fee referred to in the Telecommunications (Licence Fees) Regulations, 2003, during the month following the date of expiration.
7. Where the licensee fails to comply with any provision of these Regulations or any conditions referred to in regulation 5, the Minister may cancel or refuse to renew the licence.
8. The Wireless Telegraphy (Video Tape Rental Service) Regulations, 1983 are hereby revoked. | ||||||||||||||||||||||||||||

CONDITIONS
A licence to operate a video rental service will be issued subject to the following conditions:
1. No person shall operate a video tape rental service except in accordance with the Telecommunications Act, 2001-36 and the Telecommunications (Video Tape Rental Service) Regulations, 2004, and the conditions contained in the licence.
2. A person who has been granted a licence to operate a video rental service shall:
(1) keep on the premises on which the video service is operated a register to be known as the "Video Tape Register", in which shall be entered the names and addresses of every person to whom he has provided the video service;
(2) make the Video Tape Register available for inspection by the Minister or a person delegated by him;
(3) keep a record book to be known as the "Video Tape Record Book" in which shall be entered the transactions made by him in respect of the service. | ||||||||||||||||||||||||||
