Section 78(1) of the Telecommunications Act-36 states that it is an offence to provide or offer a telecommunications service without a licence.
The offender is liable on conviction on indictment to a fine of $500,000 or to imprisonment for a term of five years and in the case of a continuing offence $10,000 for each day or part thereof that the offence continues.
Section 79 states that a person not being a carrier or service provider who advertises telecommunications services commits an offence and is liable on conviction on indictment to a fine of $250,000 or to imprisonment for a term of three years.
